MAINTENANCE / SPOUSAL SUPPORT
Under New York State Law, a formula is utilized to determine how much maintenance or spousal support should be paid from one party to the other during the pendency of a matrimonial action. With respect to permanent maintenance to be paid after a divorce action has ended, the Court reviews various factors in determining how much should be paid and for how long, such as the educational background and health of the parties, the lost earning capacity of a party, the number of years it would take a party to be fully self supporting, and the needs of the payor spouse. While there is currently a “bill” pending to have a set formula to determine the amount of permanent maintenance as well as the time period, at the current time, the amount of spousal support is left up to the Justice presiding over your divorce case.
