LEGAL SEPARATION

Legal Separation involves entering into a valid Agreement of Separation wherein the rights and responsibilities of each spouse are defined in the Agreement but the marriage does not officially end. Issues dealt with in an Agreement of Separation include maintenance or spousal support, child custody, child support, visitation, division of assets and property rights. If the parties ultimately agree to end the marriage after having lived separate and apart for one year or more after entering into an Agreement of Separation, the Agreement of Separation can be incorporated into a Judgment of Divorce, at which time it will become a Court Order without the need to renegotiate the specific terms.
